Paperwire is yours to use on your Apple devices. The articles belong to their publishers.
Premium is sold through Apple. The yearly plan renews until you cancel it in your Apple ID settings; Lifetime is a one-time purchase.
The natural voices come with use rules from their makers. In short: don't use them to deceive, impersonate or harm anyone.
The app is provided as it is. New Mexico law applies.
1. This agreement
These Terms of Use ("Terms") are an agreement between you and GRAPHIQ STUDIO LLC, a New Mexico limited liability company ("we", "us"), about the Paperwire app for iPhone ("Paperwire" or "the app"). By downloading or using Paperwire, you agree to these Terms and to our Privacy Policy. If you don't agree, don't use the app.
2. Your licence to use Paperwire
We grant you a personal, non-exclusive, non-transferable, revocable licence to use Paperwire on Apple-branded devices that you own or control, as permitted by Apple's Usage Rules in the App Store Terms of Service. Family Sharing may let other members of your family use the app and eligible purchases. You may not rent, lease, sell or redistribute the app as distributed through the App Store, or use it to provide a service to others.
3. Articles, feeds and your sources
Paperwire is a reader. The articles, images and other material you read or listen to belong to their publishers and authors. We don't host, edit or endorse that content and aren't responsible for it.
You choose your sources, whether from our list of suggestions, by website address or through your own FreshRSS server, and you are responsible for following their terms, including paywalls and subscriptions.
Reading articles aloud, loading full articles and keeping them offline are for your personal use. Don't redistribute or publish articles, or audio made from them, without the rights holder's permission.
Our list of suggested sources is offered for convenience. Publishers may change or stop their feeds at any time.
4. Voices and their use rules
Paperwire reads with Apple's voices and with natural voices that run on your iPhone. Apple's voices are provided under Apple's terms.
Our included voice, Ivy, and the other Supertonic voices in Paperwire are based on Supertonic-3 by Supertone Inc. They are licensed under the BigScience OpenRAIL-M licence. That licence requires everyone who uses the voices to follow its use restrictions (its "Attachment A"). Those restrictions are part of these Terms, and you agree to them. In plain words, you agree not to use these voices, or audio made with them:
in any way that breaks a law or regulation;
to exploit or harm minors in any way;
to make or spread verifiably false information meant to harm others;
to make or spread personal information that can be used to harm someone;
to publish machine-generated content in any context, such as posts, articles or bots, without clearly saying that it is machine-generated;
to defame, disparage or harass others;
to impersonate, or try to impersonate, anyone;
for fully automated decisions that harm someone's legal rights or create or change a binding obligation;
to discriminate against or harm people based on their online or offline behaviour or on known or predicted personal or personality characteristics;
to exploit the vulnerabilities of a group of people based on their age or their social, physical or mental characteristics, in a way that is likely to cause physical or psychological harm;
to discriminate against people based on legally protected characteristics;
to give medical advice or interpret medical results;
for the administration of justice, law enforcement, immigration or asylum processes, such as predicting whether someone will commit a crime.
If the licence text and this summary differ, the licence text applies. Other natural voices, such as Kokoro and Paradee, are licensed under the Apache License 2.0. A voice you add from your own speech server is governed by the terms of that server and its voices.
5. Paperwire Premium
Paperwire is free to use, and some features are part of Paperwire Premium. Premium is sold through the App Store as:
a yearly subscription, which renews automatically each year;
Lifetime, a one-time purchase with no recurring fee;
Lifetime for families, a one-time purchase you can share through Family Sharing. Owners of Lifetime may be offered an upgrade to it.
Prices are shown in the App Store before you buy, and may vary by country. Payment is charged to your Apple ID when you confirm the purchase.
Renewal and cancellation. The yearly subscription renews automatically at the then-current price unless you turn off auto-renew at least 24 hours before the end of the current period. Your Apple ID is charged within 24 hours before the period ends. You can manage or cancel the subscription in your iPhone's Settings, under your name, then Subscriptions. Cancelling stops future renewals; Premium stays active until the end of the period you paid for.
Refunds are handled by Apple under its policies. We can't issue refunds for App Store purchases ourselves.
What Lifetime means. Lifetime unlocks the Premium features of Paperwire for as long as we offer the app, without recurring fees. Paperwire's voices and features run on your iPhone; neither Premium nor Lifetime includes services that run on our servers.
We may change which features are part of Premium. If we remove a Premium feature you paid for, we'll try to offer a reasonable alternative.
6. Acceptable use
Don't use Paperwire to break the law or anyone's rights, to overload or attack websites or servers, or to get around paywalls, access controls or technical protections. Don't reverse engineer the app as distributed through the App Store except as the law allows, or as the source code licence described in section 8 permits.
7. Other services
Paperwire works with services that we don't control: the websites and feeds you follow, your FreshRSS server, Hugging Face (which hosts the voice downloads), your own speech server if you add one, and Apple. Their terms and privacy policies apply to your use of them, and we aren't responsible for their availability or content. You are responsible for your own internet connection and any data charges.
8. Source code and trademarks
Paperwire's source code is published separately under the Functional Source License 1.1, Apache 2.0 Future License (FSL-1.1-ALv2). That licence governs the source code; these Terms govern the app as distributed through the App Store. The Paperwire name, logo and app icon are trademarks of GRAPHIQ STUDIO LLC and are not licensed to you under either.
9. App Store terms
If you got Paperwire from Apple's App Store, the following also applies:
Acknowledgement. These Terms are between you and us only, not Apple. We, not Apple, are solely responsible for Paperwire and its content.
Scope of licence. Your licence is limited to a non-transferable licence to use the app on Apple-branded products that you own or control, as permitted by the Usage Rules in the App Store Terms of Service, except that the app may be accessed and used by other accounts associated with you through Family Sharing or volume purchasing.
Maintenance and support. We are solely responsible for any maintenance and support of the app. Apple has no obligation to provide maintenance or support for it.
Warranty. If the app fails to conform to any warranty that applies by law, you may notify Apple, and Apple will refund the purchase price, if any, for the app. To the maximum extent permitted by law, Apple has no other warranty obligation for the app. Any other claims, losses, liabilities, damages, costs or expenses attributable to a failure to conform to a warranty are our responsibility, to the extent they can't be disclaimed under section 10.
Product claims. We, not Apple, are responsible for addressing any claims by you or a third party relating to the app or your possession or use of it, including product liability claims, claims that the app fails to conform to any legal or regulatory requirement, and claims under consumer protection, privacy or similar laws.
Intellectual property. If a third party claims that the app or your possession and use of it infringes their intellectual property rights, we, not Apple, are solely responsible for the investigation, defence, settlement and discharge of that claim.
Legal compliance. You represent and warrant that you are not located in a country subject to a US Government embargo or designated by the US Government as a "terrorist supporting" country, and that you are not listed on any US Government list of prohibited or restricted parties.
Developer contact. Questions, complaints or claims about the app go to us at the address in section 15.
Third-party terms. You must comply with any applicable third-party terms when using the app.
Third-party beneficiary. Apple and its subsidiaries are third-party beneficiaries of these Terms. Once you accept these Terms, Apple has the right, and is deemed to have accepted the right, to enforce them against you as a third-party beneficiary.
10. No warranty
To the extent the law allows, Paperwire is provided "as is" and "as available", without warranties of any kind, express or implied, including warranties of merchantability, fitness for a particular purpose and non-infringement. We don't promise that the app will be error-free or uninterrupted, that every feed or website will work with it, or that narration will be accurate. Some countries don't allow these exclusions, so some of them may not apply to you.
11. Limitation of liability
To the extent the law allows, we won't be liable for any indirect, incidental, special, consequential or punitive damages, or for any loss of data, profits or goodwill, arising from your use of Paperwire. Our total liability for any claim about the app is limited to the greater of the amount you paid for Paperwire Premium in the 12 months before the claim and 50 US dollars. Nothing in these Terms limits liability that can't be limited by law, such as for fraud, or for death or personal injury caused by negligence.
12. Ending this agreement
You can stop using Paperwire at any time by deleting it. If you break these Terms, your licence ends automatically. Sections 3, 4, 8 and 10 to 13 continue to apply after this agreement ends.
13. Governing law
These Terms are governed by the laws of the State of New Mexico, USA, without regard to its conflict-of-laws rules. Any dispute will be decided by the state or federal courts located in New Mexico, and you and we consent to their jurisdiction. If you are a consumer living in the European Union, the United Kingdom or another country whose laws give you mandatory rights, nothing in these Terms takes those rights away, and you may also bring a claim in your local courts.
14. Changes to these terms
We may update these Terms as Paperwire changes. We'll post the new version on this page with a new effective date, and mention important changes in the app's release notes. If you keep using Paperwire after a change takes effect, the new Terms apply. If a part of these Terms can't be enforced, the rest still applies.
